Terms of Service
1. Introduction
Welcome to mydaksh.ai ("MyDaksh", "we", "our", or "us"). These Terms of Service ("Terms") govern your access to and use of our website, products, and services (collectively, the "Service"). By creating an account, installing our widget, or otherwise using the Service, you agree to be bound by these Terms.
If you are using the Service on behalf of a company, organization, or other legal entity, you represent that you have the authority to bind such entity to these Terms. In that case, "you" and "your" will refer to that entity.
2. AI Disclaimer & Accuracy
Important Note on AI-Generated Content
The Service uses generative AI models to assist with automated conversations, content generation, and knowledge retrieval. While we continuously improve our systems, AI outputs may occasionally be incomplete, outdated, or factually incorrect ("hallucinations").
You are solely responsible for reviewing, validating, and approving any AI-generated responses before relying on them for business, legal, medical, financial, or other critical decisions. MyDaksh does not provide professional advice and is not liable for losses arising from reliance on AI-generated content.
You acknowledge that AI-generated responses are probabilistic and may vary between identical prompts. The Service is intended to augment, not replace, your human staff. You remain fully responsible for the information, instructions, and data you provide to the Service, as well as for configuring escalation paths, fallbacks, and human review workflows.
You agree not to present AI-generated responses as guaranteed facts, legal advice, medical advice, or any other form of professional guidance. Where required by law or good practice, you should clearly disclose to your end users that they are interacting with an AI system.
3. User Data & Privacy
In the course of providing the Service, we process data that you or your end users submit, including conversation transcripts, contact details, and business documents ("Customer Data"). We only use Customer Data to provide, maintain, and improve the Service, and we do not use your proprietary business data to train public models.
You are responsible for ensuring that you have all necessary rights, consents, and authorizations to submit Customer Data to the Service, including from your end users. You must not upload or transmit any data that violates applicable law or infringes the rights of any third party.
- Data Security: We implement reasonable technical and organizational measures to protect Customer Data against unauthorized access, loss, or disclosure.
- Data Retention: We retain Customer Data for as long as your account is active or as needed to provide the Service, unless you request deletion earlier where permitted by law.
- Privacy Policy: Additional details on our data practices are described in our Privacy Policy, which is incorporated into these Terms by reference.
4. Third-Party Services (Including Google Calendar)
Certain features of the Service, such as Appointment Booking for AI agents, allow you to connect third-party services—including Google Calendar—so that appointments booked through your AI agent can be synced to your calendar. Use of these integrations is optional and is subject to the third party's terms of service and privacy policy, in addition to these Terms.
Google Calendar API: When you connect Google Calendar, we use Google's OAuth and the Google Calendar API solely to create, read, or update calendar events that correspond to appointments managed by your AI agent. We do not use your Google Calendar data for advertising, resale, or any purpose other than providing the appointment-sync feature. You are responsible for ensuring that your use of the Google Calendar integration complies with Google's Terms of Service and the Google API Services User Data Policy (including any restrictions on transfer or use of user data).
No endorsement; revocation: We do not control and are not responsible for the availability, accuracy, or conduct of third-party services. Our inclusion of an integration does not imply endorsement of the third party. You may revoke our access to your Google Calendar at any time from your Google Account settings or from within the Service; revocation will stop future syncing but will not delete events already created in your calendar.
To the extent permitted by law, MyDaksh shall not be liable for any loss, damage, or claim arising from your use of third-party services (including Google Calendar), their unavailability, or any actions or policies of the third-party provider.
5. Payments, Subscriptions & Trials
Certain features of the Service are provided on a paid subscription basis. By starting a subscription, you authorize us and our payment processors to charge you the applicable fees, taxes, and charges using the payment method you provide.
- Billing Cycle: Subscription fees are billed in advance on a recurring basis (e.g., monthly or annually) as selected during checkout.
- Trials: If you start a free trial, it will automatically convert to a paid subscription at the end of the trial period unless you cancel beforehand.
- Changes & Cancellations: You may upgrade, downgrade, or cancel your plan from within your account settings. Changes may take effect in the next billing cycle unless otherwise stated.
- Refunds: Except where required by law, all fees are non-refundable once paid.
6. Limitation of Liability
To the maximum extent permitted by law, MyDaksh and its affiliates, officers, employees, and partners shall not be liable for any indirect, incidental, consequential, special, or exemplary damages, including loss of profits, revenue, data, or business opportunities, arising out of or in connection with your use of the Service.
Our total aggregate liability for all claims relating to the Service shall not exceed the greater of: (a) the amount you paid to us for the Service in the twelve (12) months preceding the event giving rise to the claim; or (b) one hundred (100) US dollars, if you are using the free plan.
7. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which MyDaksh is incorporated, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms or the Service shall be resolved exclusively in the competent courts of that jurisdiction.
Before initiating formal legal proceedings, you agree to first contact us and provide a brief written description of the dispute, along with your contact information, so that we may attempt to resolve the matter informally.
